Our Terms

  1. These Terms explain how you may use this website (the Site), which is provided by us free of charge. 
  2. References in these Terms to the Site includes the following websites and all associated subdomains and web pages:

  3. You should read these Terms carefully before using the Site. 
  4. By accessing or using the Site or otherwise indicating your consent, you agree to be bound by and comply with these Terms and the documents referred to in them. 
  5. If you do not agree with or accept any of these Terms, you should stop using the Site immediately.

  7. We recommend that you print a copy of these Terms for future reference. 
  8. We may transfer our rights and obligations under these Terms to another organisation. We will always tell you in writing if this happens, and we will ensure that the transfer will not affect your rights under the contract.
  9. You are responsible for ensuring that all persons who access our Site through your internet connection are aware of these Terms, and that they comply with them.
  10. Definitions: 
    1. “Climate Explorers, we, us or our” means Climate Explorers Community Eco-Adventures CIC (company registration number 15722735) the registered office of which is at:
      38 Sonning Gardens, Hampton, United Kingdom, TW12 3PL
      References to us in these Terms also includes any group companies which we may have from time to time; 
    2. “Content” means any text, images, logos, video, audio or other multimedia content, documents, downloadable file software or other information or material submitted to or on the Site;
    3. “Cookie policy” means the policy (https://climateexplorers.co.uk/cookie-policy/), which governs how we use cookies in the Site; 
    4. “Eco-Adventure” means an eco-adventure organised by Climate Explorers, as advertised on the Site;
    5. “Intellectual property rights” means rights such as copyright, trademarks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind whether or not they are registered or unregistered (anywhere in the world); 
    6. “Privacy policy” means the policy (https://climateexplorers.co.uk/privacy-notice/), which governs how we process any personal data collected from you;
    7. “Site” means the following websites and all associated subdomains and web pages:

    8. “Terms” means these terms and conditions of use as updated from time to time; 
    9. “Unwanted Submission” has the meaning given to it in the section entitled “submitting information to the Site”; and
    10. “You or your” means the person accessing or using the Site or its Content. 
  11. We are regulated by:
    Office of the Regulator of Community Interest Companies (hereafter our “Regulators”) 
  12. Your use of the Site means that you must also comply (where applicable) with our: 
    1. Privacy policy
    2. Acceptable use policy; and 
    3. Cookie policy 
  13. If you choose to book an Eco-Adventure using the Site, our Eco-Adventure Client Contract will apply to your booking.
  14. Severability:
    If at any time any of the provisions set forth in these Terms are found to be inconsistent or invalid under applicable law, those provisions will be deemed void and will be removed from these Terms. All other provisions will not be affected by the removal, and the rest of these Terms will still be considered valid.
  15. We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms at any time. For example, this may be done to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site. Your continued use of the Site following the notification and implementation of changes will mean that you accept and agree to the changes.

Using the Site 

  1. The Site is for your personal, non-commercial and non-exclusive use only. In exchange for your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, and non-commercial limited privilege to enter and use the Site. 
  2. You may not use any “page-scraper”, “robot”, “spider”, “deep-link” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, copy, acquire, or monitor any part of the Site, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. 
  3. You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our Site or any services provided via, or in relation to, our Site for any purpose, including the development, training, fine-tuning or validation of AI systems or models. This includes using (or permitting, authorising or attempting the use of):
    1. any “robot”, “bot”, “spider”, “scraper” or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of our site or any data, content, information or services accessed via the same; or
    2. any automated analytical technique aimed at analysing text and data in digital form to generate information or develop, train, fine-tune or validate AI systems or models which includes but is not limited to patterns, trends and correlations.
  4. The provisions in this paragraph should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).
  5. This includes using (or permitting, authorising or attempting the use of):

  8. The provisions in this clause should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).
  9. You shall not use, and we do not consent to the use of, our Site, or any data published by, or contained in, or accessible via, our Site or any services provided via, or in relation to, our Site for the purposes of developing, training, fine-tuning or validating any AI system or model.
  10. You may not attempt to gain unauthorised access to any part or feature of the Site, or any other systems or networks connected to the Site or to any of our servers, or to any of the services offered on or through the Site, by password “mining”, hacking or any other illegitimate means. 
  11. You may not scan, probe or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site. 
  12. You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the Site, or any other client of ours, to its source, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Site. 
  13. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or our systems or networks, or any systems or networks connected to the Site. 
  14. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted on the Site, or with any other person’s use of the Site. 
  15. You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to us on or through the Site or any service offered on or through the Site. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity. 
  16. You may not use the Site or any Content for any purpose that is unlawful or prohibited by these Terms, or to solicit the performance of any illegal activity or other activity which infringes our rights or those of others. 
  17. The Site is intended for use only by those who can access it from within the UK. If you choose to access the Site from locations outside the UK, you are responsible for compliance with local laws where they are applicable. 
  18. You agree that you are solely responsible for: 
    1. all costs and expenses you may incur in relation to your use of the Site; and 
    2. keeping your password and any other account details which may be necessary or required confidential.

  20. We may prevent or suspend your access to the Site if you do not comply with any part of these Terms, any terms or policies to which they refer or any applicable law.
  21. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
  22. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.
  23. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at hello@climateexplorers.co.uk.

 

Ownership, use and intellectual property rights

  1. This Site and all intellectual property rights in it, including but not limited to any Content, are owned by us, our licensors or both (as applicable). We and our licensors reserve all of our and their rights in any intellectual property in connection with these Terms. This means, for example, that we and they remain owners of them and free to use them as we and they see fit. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
  2. You may print off one copy, and may download extracts, of any page(s) from our Site for your personal use and you may draw the attention of others within your organisation to content posted on our Site.
  3. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
  4. Our status (and that of any identified contributors) as the authors of Content on our Site must always be acknowledged (except where the content is user-generated).
  5. You must not use any part of the Content on our Site for commercial purposes without obtaining a licence to do so from us or our licensors.
  6. If you print off, copy, download, share or repost any part of our Site in breach of these terms of service, your right to use our Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made (except that you are permitted to print off a copy of these Terms).
  7. Nothing in these Terms grants you any legal rights in the Site other than as necessary to enable you to lawfully access the Site as intended and authorised by us. You agree not to adjust to try to circumvent or delete any notices contained on the Site (including any intellectual property notices) and in particular in any digital rights or other security technology embedded or contained within the Site. 
  8. Trademarks. Our trademarks are registered, and you are not permitted to use them without our approval, unless they are part of material you are using in accordance with these Terms:

      5. Spotify Logo – Spotify. 
  9. Other trademarks and trade names may also be used on this Site. The use of any trademarks on the Site is strictly prohibited unless you have our prior written permission.

Submitting information to the Site

  1. Whenever you make use of a feature that allows you to create Content directly on our Site, upload or share Content to our Site, or to make contact with other users of our Site, you must comply with the standards set out in our Acceptable Use Policy.
  2. You warrant that any such contribution complies with those standards, and you are liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
  3. While we try to make sure that the Site is secure, we cannot guarantee the security of any information that you supply to us. We therefore cannot guarantee that it will be kept confidential. For that reason, you should not submit any patentable ideas or patent applications, advertising or marketing suggestions, prototypes, or any other information that you regard as confidential, commercially sensitive or valuable (Unwanted Submissions) to the Site. While we value your feedback, you agree not to submit any Unwanted Submissions. 
  4. We will consider any Content you upload to our Site to be non-confidential and not protected by any trade mark, patent or copyright (“non-proprietary”), that is, in the public domain. You own your Content, but you are required to grant us and other users of our Site a limited licence to use, store and copy that Content and to distribute and make it available to others. 
  5. When you upload or post Content to our Site, you grant us the following rights to use that Content:
    1. a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that user-generated content in connection with the service provided by the website and across different media including to promote our Site or the services to expire when the user deletes the Content from our Site; and
    2. a worldwide, non-exclusive, royalty-free, transferable licence for other users, partners or advertisers to use the Content in accordance with the functionality of our Site to expire when the user deletes the Content from our Site.
  6. We may use any Unwanted Submissions as we see reasonably fit on a free-of-charge basis (bear in mind that we have no way of knowing whether such information is confidential, commercially sensitive or valuable because we do not monitor the Site to check for these matters). Therefore, we will not be legally responsible for keeping any Unwanted Submissions confidential, nor will we be legally responsible to you or anybody else for any use of such Unwanted Submissions. 
  7. We also have the right to disclose your identity to anyone who is claiming that any Content posted or uploaded by you to our Site violates their intellectual property rights or their right to privacy.
  8. We have the right to remove any posting you make on our Site if, in our opinion, your post does not comply with the acceptable use standards set out in our Acceptable Use Policy.

Accuracy of information and availability of the Site 

  1. While we try to make sure that the Site is accurate, up-to-date and free from bugs or viruses, we cannot guarantee that it will be. You are responsible for configuring your information technology, computer programs and platform to access our Site. You should use your own virus protection software.
  2. Furthermore, we cannot guarantee that the Site will be fit or suitable for any purpose. Any reliance that you may place on the information on this Site is at your own risk. 
  3. We may suspend or terminate operation of the Site at any time as we see fit. 
  4. Content is provided for your general information purposes only and to inform you about us and our products and news, features, services and other websites that may be of interest. It does not constitute technical, financial or legal advice or any other type of advice and should not be relied on for any purposes. 
  5. While we try to make sure that the Site is available for your use, we do not promise that the Site is available at all times nor do we promise the uninterrupted use by you of the Site. 
  6. Our Site may include information and materials uploaded by other users. This information and these materials have not been verified or approved by us. The views expressed by other users on our Site do not represent our views or values.
  7. You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or otherwise harmfully interacting with our Site or any part of it. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site or any other equipment or network connected with our Site. You must not interfere with, damage or disrupt any software used in the provision of our Site or any equipment or network or software owned or used by any third party on which this Site relies in any way. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

Hyperlinks and third party sites 

  1. The Site may contain hyperlinks or references to third party websites other than the Site. Any such hyperlinks or references are provided for your convenience only. We have no control over third party websites and accept no legal responsibility for any content, material or information contained in them. The display of any hyperlink and reference to any third party website does not mean that we endorse that third party’s website, products or services. Your use of a third party site may be governed by the terms and conditions and privacy policy of that third party site. 
  2. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to our Site in any website that is not owned by you. Our Site must not be framed on any other site, nor may you create a link to any part of our Site other than the home page. We reserve the right to withdraw linking permission without notice. The website in which you are linking must comply in all respects our Acceptable Use Policy. Events beyond our control 

We shall have no liability to you for any breach of these Terms caused by any event or circumstance beyond our reasonable control including, but not limited to, strikes, lock-outs or other industrial disputes; breakdown of systems or network access; or flood, fire, explosion or accident. 

Limitation of liability

  1. Whether you are a consumer or a business user, we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation. Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any services relating to Eco-Adventures to you, which will be set out in the relevant contract. 
  2. If you are a business user, we exclude all implied conditions, warranties, representations or other terms that may apply to our Site or any Content on it. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
    1. use of, or inability to use, our Site; or
    2. use of or reliance on any Content displayed on our Site.
  3. In particular, we will not be liable for loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.
  4. If you are a consumer user, you acknowledge that we only provide our Site for domestic and private use. You agree not to use our Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Climate Explorers Community Eco-Adventures CIC and our directors, officers, agents, employees, volunteers, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your breach of these Terms.

Rights of third parties 

No one other than a party to these Terms has any right to enforce any of these Terms. 

Disputes 

  1. We will try to resolve any disputes or complaints you may have quickly and efficiently. 
  2. If you are unhappy with us, please contact us as soon as possible. 
  3. We shall always endeavour to resolve any problem or issue that may arise between you and us as efficiently and smoothly as possible, however where this is not possible, and you wish to raise a formal complaint, we can be contacted in the following ways:

  4. We shall always aim to remedy your complaint promptly. Where such remedy is not available immediately, we shall acknowledge receipt of your complaint in writing within 5 working days of the complaint being made. Where your complaint concerns services provided by us through the Site, we shall aim to give you our response within 10 days after the complaint has been received by us. Where the complaint relates to exceptional circumstances which are beyond our control, such circumstances include but are not limited to: internet service provider failure; power failure; acts of God; pandemic; epidemic; fire; flood; droughts; storms; civil unrest; collapse of buildings; earthquakes; explosion; accidents; acts of war or terrorism; or any law or actions taken by government or public authorities or any other event that is beyond our control we shall aim to respond to your complaint within a maximum of 31 working days of the complaint being made. If your complaint does not relate to any service provided by us through the Site, we shall aim to provide a response to your complaint within 4 weeks of the complaint being made, and where we shall take longer than 4 weeks, we shall inform you of this. 
  5. If you and we cannot resolve a dispute using our complaint handling procedure, we will: 
    1. let you know that we cannot settle the dispute with you; and 
    2. consider the need for Alternative Dispute Resolution and, if considered necessary, provide you with information about any alternative dispute resolution provider we deem appropriate to deal with your complaint. 
    3. provide you with information about our Regulators and their complaints and/or Alternative Dispute Resolution services. 
  6. If you want to take court proceedings, the relevant courts of the United Kingdom will have exclusive jurisdiction in relation to these Terms. 
  7. these Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales
